General terms and conditions of sale of products sold on www.lumyfashion.com

Article 1 - Purpose
The present conditions govern sales made by the company Triqwantum Limited, which markets the clothing brand Lumy of Paris on the www.lumyfashion.com site.
Article 2 - Prices
The prices of our products are indicated in Euros (except in GBP for the UK site) and include all taxes (VAT and other taxes applicable on the date of the order), unless otherwise indicated, and do not include handling and shipping charges.
For orders to countries other than Ireland, you are the importer of the products concerned. Customs duties, local taxes, import duties, or state taxes may be payable. These taxes and duties are not the responsibility of the company Triqwantum Limited. They are to be paid by the customer, who is entirely responsible for all charges due in his country. We advise you to inquire about these charges from your local authorities.
All orders, whatever their origin, are payable in Euros (except GBP in the UK). The company Triqwantum Limited reserves the right to change its prices at any time, but the products will be charged based on the rate in effect at the time of confirmation of the order and subject to availability.
The products delivered to the Client remain the property of Triqwantum Limited until full payment of the amunt due has been received.
Notice: When you take physical possession of the goods ordered, the risk of loss or damage to the goods are transferred to you.

Contractual information is presented in the English language and will be reconfirmed at the time of your order.
The company Triqwantum Limited reserves the right not to credit a payment, and not to confirm an order, for any reason, including in the event of supply problems, or in case of difficulties with the order received.
Article 4 - Validation of your order
All orders placed on the website www.lumyfashion.com require the adherence to all present Terms and Conditions. An order confirmation implies your full acceptance of these terms and conditions, without exception or reservation.
All the records and confirmed date are considered valid proof of transaction.
You acknowledge to have fully understood and accepted these rules as explained on our website.
The order confirmation will serve as proof of signature and acceptance of the transaction.
You will receive a summary of your order confirmation, and the present Terms and Conditions will be sent in PDF format to the e-mail address you provided when confirming your order.
Article 5 - Payment
Clicking to confirm your order implies the obligation for you to pay the quoted price.
Payment for your purchases is made by credit or debit card by means of the secure payment system (SSL).
Your card will be debited when your order is shipped. If the deliveries are split, the products will be charged separately.
Article 6 - Cancellation
In accordance with the provisions of Article L.121-21 of the Consumer Code, you have a 14-day period from the reception of your articles to exercise your right of cancellation without having to give any reason or incurring penalties.
You are liable to make all returns in their original condition and complete (including packaging, accessories, and manuals). The Vendor may refuse to accept the cancellation if thereturned product shows signs of damage, usage, or wear and tear.
You will not be charged for return shipping costs.
In case of exercising the right of cancellation, the company Triqwantum Limited will refund the sums paid within 14 days of the notification of your application and via the same means of payment used by the user for the initial transaction.
EXCEPTIONS TO THE RIGHT OF CANCELLATION
Pursuant to the provisions of Article L.121-21-8 of the Consumer Code, the right of cancellation does not apply to:
- when fully implemented services are given before the end of the withdrawal period and when the performance of the services has began after prior express consent of the consumer and express renunciation of his right of withdrawal.
- The supply of goods is made to the consumer's specifications or clearly personalized.
- The supply of goods which were unsealed by the consumer after delivery and cannot be returned for hygiene or health protection reasons.
- The supply of goods which, having been delivered and by their nature, inseparably mixed with other items.
Article 7 -Availability
Our products are available as long as they are visible on the website and in the www.lumyfashion.com stocks. For products not in stock, our offers are valid subject to availability from our suppliers.
In case of unavailability of product after placing your order, you will be notified by e-mail. Your order will be canceled and no bank debit will be made.
In addition, the website Lumy by Paris www.lumyfashion.com does not intend to sell its products in large quantities. Therefore the company Triqwantum Limited reserves the right to refuse orders of 100 identical items or to calculate a special delivery time.
Article 8 - Delivery
The products are delivered to the shipping address provided during the processing of order, within the time stipulated on the order validation page.
In case of delay in shipment, an email will be sent to inform you of a possible impact on the delivery time that was indicated to you.
As required by law, in case of delay in delivery, you get the option to cancel the order as per the terms and conditions set out in Article L 138-2 of the Consumer Code. If in the meantime you receive the product we will proceed to its refund and of possible delivery charges as per the conditions of Article L 138-3 of the Consumer Code.
In case of delivery by a carrier, the Company Triqwantum Limited cannot be held responsible for late delivery due exclusively to the unavailability of the client after several appointment offers.
Article 9 - Warranty
All products benefit from the legal guarantee of compliance and the guarantee against hidden defects, provided by Article 1641 of the Civil Code. In case of non-compliance of a product sold, it can be returned, exchanged or refunded.All claims , requests for exchange or refund must be made by email firstname.lastname@example.org within 30 days of delivery.The products must be returned in the condition in which you received them with all the elements (accessories, packaging, instructions ... ). The shipping costs will be reimbursed on the basis of the invoiced price, return shipping costs will be supported if you use the carrier indicated by us.
The provisions of this article do not prevent you from benefiting from the right of withdrawal foreseen by Article 6.
Article 10 - Liability
The products comply with European legislation. The Company Triqwantum Limited cannot be held liable for non-compliance with the legislation of the country where the product is delivered. It is your responsibility to check with local authorities the possibilities of importation or use of products or services you plan to order.
Also, Triqwantum Limited cannot be held liable for damages resulting from misuse of the purchased product.
Finally, the Company Triqwantum Limited cannot be held responsible for any inconvenience or damage arising from the use of the Internet, including a break in service, external intrusion or presence of viruses.
Article 11 - Applicable law in case of disputes
These Terms and Conditions of Use shall be governed by and construed in accordance with the laws of Ireland. The language of this contract is English. These terms and conditions are subject to Irish law. In the event of a dispute, the Irish courts shall have exclusive jurisdiction and you hereby agree to submit to the exclusive jurisdiction of such court.
Article 12 - Intellectual Property
All materials featured on the site www.lumyfashion.com are and remain the exclusive intellectual property of Triqwantum Limited. You may not reproduce, use, repost, or use for any purpose whatsoever, totally or partially, elements of the site whether they are software, visual or sound. Any single link or hyperlink is strictly prohibited without the express written consent of the company Triqwantum Limited.
Article 13 - Personal data
The Triqwantum Limited reserves the right to collect personal information and personal data. They are necessary to manage your order and to improve services and information we send you.
